Why Hijrah! WARNING: You don’t help the Kuffar in killing and oppressing Muslims and plotting against Islam.

Bismillah

Al Hamdulillah

Wa AsSalatu AsSalamu A’ala Rasulillah

Allah said, DO NOT obey the Kuffar.

(Al-Furqan 25:52)

But you?

You are not only obeying, you’re submitting yourself to Kuffar’s Deen.

Rasulullah Sallillahu Alaihi Wa Sallam said,

Whoever takes arms against us, he is not from us

(Saheeh Bukhari 6874)

But you?

You’re part of the Kuffar’s  oppression, killing of Muslims and you’re aiding the Kuffar in plotting against Muslims.

And Allah said the consequence of obeying the Kuffar:

They will turn you back on your heels, and you will [then] become losers“. (Ale Imran 3:149)

For sure, you really are in a dangerous situation, those who are living and settling under Kuffar’s authority.

You are involved in two major crimes.

Obeying, submitting yourself to ‘Kuffar's Deen‘, ‘Kuffar's Shariah‘.

And Knowingly or unknowingly helping Kuffar in killing and oppressing Muslims and aiding them in plotting against Islam.

These crimes could be accounted for as Kufr.
Allahu A’lam.
Let me explain.

How do you get involve in it?

To get to a clear understanding of this, let’s do a Critical Reasoning of this Hadith.

Rasulullah Sallillahu Alaihi Wa Sallam said,

Whoever takes arms against us, he is not from us

(Saheeh Bukhari 6874)

Who is Rasulullah talking about here?

A Kafir?

No!

A Kafir is already not ‘from us’.

Then, who else He is talking about?

A Muslim.

When a Muslim takes arms against the Ummah of Muslim, he doesn’t belong to Islam anymore.

How does this issue relates to Hijrah!

Well, It does.

Let me explain.

The one who helps doing a crime, is he also guilty of crime?

Yes!

The one who helps in murder, is he also guilty of murder?

Yes!

Then, those who fight Muslim, isn’t aiding them also be fighting with them yourself?

You do the math!

Let me put it in a way so that a 13 year old can understand the issue easily.

There’s a million dollar masjid project.

You give only $10 Sadaqah.

Why?

Expecting Sadaqah Jaariah, continuous reward of your portion of $10.

Expecting Allah will reward you abundantly.

Thinking, may be just this Sadaqah would be a cause of your saving from Jahannam.

So, put this scenario in your portion of Tax that these Kuffar governments use for.

These are the money that governments use to maintain their state affairs, right?

Isn’t it then easy to understand that you get a proportionate share all the evil they do against Muslims and against humanity?

The propagating of Zina, alcohol, gambling and what not and the example of LGBTQ is just before your eyes right now.

Is there any doubt that you will get a proportionate share of all these evils?

And then, what about their forces that fight against Muslims?

Where are those campaigns get funded from?

What about their secret forces that relentlessly plotting and propagating against Islam?

Who funded those organisations?

It is from the tax money that they collect from its people And you have a proportionate share in that.

That’s how you are helping them in killing and oppressing Muslims.

That’s how you’re aiding them in plotting against Islam.

And that’s how this Hadith applies to you, you carry arms against Muslims.

Allahu A’lam.

Therefore, calculate your status.

You do the math.

I know, you don’t  give up yet. You might be thinking, ‘I am just a victim of the system.

I didn’t choose to live in this system. I born in this system. What can I do?

Well, think this way, a Kafir also born in a Kuffar family.

Can he places his argument  in front of Al-Hakeem on the day of judgement, “I was just a victim, I born in a Kafir family, you put me in a Kafir family”

You know that, this won’t work.

He has to seek the truth and then, when he finds the truth he has to change his entire lifestyle to claim his Jannah, to save himself from Jahannam.

He sometimes has to go through challenges such as leaving his own family, friends, society. Can you even imagine the plight of those new Muslims?

And your situation is not worse than those new reverted Muslims. You know it.

Remember this, there’s millions of oppressed Muslim out there raising their hands against the oppressors and for sure you’re aiding those oppressors through your tax money while Allah instructed you to stand by the side of your oppressed brothers and do Jihad against the oppressors. But you, one way or another, knowingly or unknowingly aiding those oppressors.

Therefore, you have just only one way out from this calamity.

Hijrah!

Hijrah, away from obeying and submitting to the ‘Kuffar’s Shariah’ and away from aiding the Kuffar in their oppression of Muslims.

My brother, It’s time for Hijrah!

May Allah not make us among those who aid the Kuffar in oppressing and fighting the Muslims.

May Allah make our Hijrah easy.

O My believing servants! Surely, my earth is spacious, so worship Me ˹alone˺/ worship only Me.

Let’s do a critical reasoning (contemplate) on the Ayah

What are the subjects here?

  • (1) Earth
  • (2) Worship

What is said about these subjects?

  • (1) It says Allah’s land is spacious, land is vast. That’s easily understandable.
  • (2) And worship Allah alone.

What does it mean to 'worship Allah alone'?

Well, this means worshipping Allah without Shirk.
This is what is expected from those who call themselves Muslims.
Which is why Allah sent his messenger.
Which is why He sent the Quran.
I think that’s also easily understandable by every Muslim.

But why did Allah put these two issues together?
What’s the interrelation between these two issues?

We can derive a simple understanding that Allah, the owner of the land confirms that there’s Allah’s land where Muslims can worship Him without Shirk because He says, ‘My earth is spacious’ in relation to worship Him alone.

Another point is, since this Quran is the guide for humanity until the last day, therefore, there will always be such a land until the end of the world where Muslims would be able to worship Allah without Shirk, without submitting to ‘Kuffar’s Shariah’.
And that’s a certain knowledge.

We can also derive an implied meaning that Allah orders his servants that when living in a land becomes such that you cannot worship Allah Subhanahu Wa T’ala alone (without Shirk), you must move away to a land where you can worship Allah without Shirk.

So, when and in what circumstances does a land become a state where you cannot worship Allah alone?

We will understand that when we would know the implications of what it means to ‘worship’.
Let’s try to understand that, En Shaa Allah!

So, what does worship mean?
Simply put, it is to obey Allah, to do what Allah ordered us to do and to stay away from what He forbade us from doing.

And these two things are summarised and given the Islamic terms, which we know as
Deen of Allah‘ and ‘Shariah of Allah‘.

Therefore, let’s ask ourselves these simple questions:

(1) Does following Allah’s Deen mean worshipping Allah?
Yes!

Then, can someone claim that he worships Allah alone when he also submits to a Deen other than the Deen of Allah?
No!

(2) Does following Allah’s Shariah mean worshipping Allah?
Yes!

Then, can someone claim that he worships Allah alone when he also submits to a Shariah other than the Shariah of Allah?
No!

Does it now give some idea why Allah put these two separate issues together?

When you cannot follow Allah’s Deen in a land, you have to move to a land where you can follow Allah’s Deen.
When you cannot follow Allah’s Shariah in a land, you have to move to a land where you can follow Allah’s Shariah.

Or you can say this in the opposite way, which is,
When you are subjected to follow 'Kuffar's Deen' in a land, you have to move out from that land to a land where you can follow Allah’s Deen.
When you are subjected to obey ‘Kuffar's Shariah‘ in a land, you have to move out from that land to a land where you can follow Allah’s Shariah.

But we always hear’ “Where’s that land?
Is there a land where Allah’s Deen is followed?
Is there a land where Allah’s Shariah is implemented?

Well, this question has two implications.
If this question means you want to know something that you have no knowledge of, then it is something normal.
And in that case, we invite you to join us in that quest, if you are really sincere.

But if you are posing these questions as a challenge that there’s no such land exists where you can follow Allah’s Deen, then these questions could be the words of Kufr.

How do you say that?
Well, you’re denying something that Allah Ajja Wa Jallah Himself confirms in the Quran.
Since Allah says, “Allah’s land is vast”, in respect to worship him alone, then, there must be a land and there will be a land until the Qiyamah where you don’t have to submit to the Kuffar’s Deen, to the Kuffar’s Shariah! And that’s the Certain Knowledge for a Muslim.

And Allah knows best.
May Allah save us from following ‘Kuffar’s Deen’.
May Allah protect us from obeying ‘Kuffar’s Shariah’.
May Allah make our Hijrah easy.
Ameen.

Wa AsSalatu AsSalamu A’ala Rasulillah!

Allah ordered, “Do not obey the Kuffar” (Sura Al-Insan 76:24).

But you wholeheartedly submitted to the ‘Kuffar’s Shariah’.

Allah even warned His prophet, Muhammad Sallallahu Alaihi Wa Sallam,

“O Prophet, fear Allah and do not obey the Kuffar and the Munafiqeen. Verily Allah is All-Knowing, Most Wise.
(Sura Al-Ahzab 33:2) 

But you’re profoundly following ‘Kuffar’s Deen’.

Kuffar have rejected Allah’s Deen, instead, they set their own Deen.

Allah sent Shariah for what is the obligation for you to pay on your wealth which is. 2.5% on the yearly balance to pay to the authority of the Muslims, you know it.

Kuffar said, ‘No! we reject that. We have our own Shariah’.
‘You have to pay us such and such percentage on your sales and transactions whether you make a profit or not’,
‘You have to pay us such and such amount of TAX from your earnings whether you have gained anything or not at the end of the year’.

Allah sent Shariah forbidding Insurance,
but Kuffar said, ‘No! we reject your Shariah!’
‘You have to obey our ‘Shariah’!
‘You have to have insurance’.

In Allah’s Shariah, a child becomes an adult upon reaching puberty and he/she comes under all legal bindings that apply to an adult,
but Kuffar says, ‘No! We reject your Allah’s Shariah’!
‘You have to follow our ‘Shariah‘!
‘You have to treat a human as a child up to 18 years of age’.

So, you are obeying ‘Kuffar’s Shariah’ now.
You can’t give your daughter to a marriage below 18 years of age. If you do Kuffar will put you in jail.

And then, when you fall into any incident, such as, ‘family violence’, oppression, robbery, fighting, killing, murder, etc.,
you become subject to the Kuffar’s law,
you submit to Kuffar’s Deen,
you appear to the court of the Kuffar’s
and you stand for the judge (Taghut) as you stand in front of your Rabb.
Inna Ilaihi Wa Inna Ilaihi Rajiun.
May Allah protect you from Shirk of obeying Taghut.
May Allah protect you from Kufr of following ‘Kuffar's Deen'.

And then, while the Kuffar successfully managed to implement their 'Deen', their 'Shariah' on Muslims in the Muslim-populated lands or in the so-called Muslim lands, your job was to reject their 'Deen', reject their ‘Shariah‘.
Instead, you kept following Kuffar’s Deen in your own land.
Even that was not enough for you, you came to the Kuffar’s lands and wholeheartedly submitted to the Kuffar’s Deen.

Ask yourself, did any Kafir ever put a gun on your head to make you come to their country, obey their authority and follow their ‘Deen’, follow their ‘Shariah’?
No!
Rather you bring yourself under Kuffar’s authority and then, you claimed that they force their Deen on you. While Allah ordered you, “Do not obey the Kuffar”, but you submitted yourself to the Kuffar.

So, ask yourself.
Who do you submit to?

What would be your answer to the Malaikah when you will be asked,“Man Dinuka“? (Sunan Abu Dawood 4753)

Rather, you will be asked another question, at the time of death, before you face the question in the Qabr.

Wasn’t the earth spread for you?” [al-Nisa’ 4:97]

Didn’t I clearly inform you,

“O my servant, my earth was specious, so worship me alone“?
(Meaning, do not Shirk with me, do not give my right to others living in such a place. Move away to my spacious lands where you don’t have to give my right to others.)
(Al-‘Ankabut 29:56)

Think of the answer until you have the breath!

And before we finish this, let’s remind ourselves a couple of Ayat on the same issue, where Allah Ajja Wa Jalla commanded again, as follows:

Ash-Shu’ara’ 26:151-152
(151) وَلَا تُطِيعُوٓا۟ أَمْرَ ٱلْمُسْرِفِينَ
(152) ٱلَّذِينَ يُفْسِدُونَ فِى ٱلْأَرْضِ وَلَا يُصْلِحُونَ

(151) And do not follow the command of the transgressors,
(152) who spread corruption throughout the land, never setting things right.”

And you know how the Kuffar has spread corruption on earth. The worst of that corruption is the ocean of Riba that they pulled you and me today.

Briefly saying, only way out from that corruption is to think of off-grid living as a first step until Allah grants us Khilafah, En Shaa Allah!

And when Allah grants us Khilafah?

“Allah has promised those among you who believe and do righteous good deeds, that He will certainly grant them Khilafah (The AUTHORITY) in the land, as He granted it to those before them, and that He will grant them the authority to practise their DEEN which He has chosen for them. And He will surely give them in exchange a safe security after their fear (provided) they worship Me and do not do SHIRK with Me.
But whoever disbelieves after this, they are the Fasiqun (rebellious, disobedient to Allah)”.
(Sura An-Nur 24:55)

Subhanallah!
This is Allah’s clear promise here.
Allah will grant the Khilafah, (the authority of land) to the Muslims.
But certainly not to those who are willingly obeying the ‘Shairah of the Kuffar’, following the ‘Kuffar’s Deen’, giving Allah’s right to the Kuffar.

Wa Allahu A’lam.
May Allah give us understanding.
May Allah save us from following ‘Kuffar’s Deen’.
May Allah protect us from obeying ‘Kuffar’s Shariah’.
May Allah open a way for us to live under Allah’s Shariah!

Why Hijrah! WARNING: Why settling in Kuffar’s Land is Haram?

Al Hamdulillah!
Wa AsSalatu AsSalamu A’ala Rasulillah!

AsSalamu Alaikum Wa Rahmatullahi Wa Barakatuhu!

Rasulullah Sallallahu Alaihi Wa Sallam sent a Sariyyia (an expedition) to a tribe, the Mujahidun found a few people in prostration (to protect themselves) but they were killed.
When Rasulullah Sallillahu Alaihi Wa Sallam was informed of the incident, he said,

أَنَا بَرِيءٌ مِنْ كُلِّ مُسْلِمٍ يُقِيمُ بَيْنَ أَظْهُرِ الْمُشْرِكِينَ.

“I disown every Muslim who settles among the Mushrikeen”.

(Sunan Abu Dawud 2645. Saheeh).

My brother, You know that the entire Kuffar world is fighting against Islam, right?
Imagine, the way Kuffar has been bombing the Muslims in the Middle East, the same way Muslim countries are bombing the Kuffar’s lands. Would you then live among the Kuffar, in the Kuffar’s Land?

And if someone happens to live among the Kuffar at the time of war and therefore dies from those attacks, what would be his status with Allah, Al Haseeb, The Reckoner?
Can he show an excuse to the angels, “I was in the ‘No Fighting Zone’ Sir!”

Usually, when two countries fight and bombard each other, would you find any regular nationals living among the enemies, in the enemy country?


No way! Both countries warn their respective citizens to evacuate long before they engage in the bombing (For example, the ongoing Israel-Filistine war and Russia-Ukraine war)

To give you a practical example, imagine, the way Kuffar bombarded Iraq, the same way Iraq’s missiles and jet fighters bombarded America. Tell me, which American will go to live in Iraq or which Iraqi Muslim will go to live in America? You won’t find any.
Check the history, when the confederation of the Kuffar was fighting a crusade against Muslims, did any Muslim live and settle among the Kuffar, in the Kuffar’s lands, under the Kuffar’s authority?

and then, what about giving you the most recent example?
Filistine and Israel are at war right now. You tell me, would any Filistine would go and live in Israel?
It’s absurd, isn’t it?

And I hope that you are not in that delusion.
The kuffar and their entire confederations are fighting the Muslims and fighting against Islam. This is the truth. If you really know this truth, then, you really won’t want to live among the Kuffar, in the Kuffar’s land, under the Kuffar’s authority if there is a fighting back from the Muslim countries with the Kuffar’s countries.

So, my brother, Is this the fact that because the Kuffar’s lands are not attacked by the Muslim countries makes it permissible/ safe for you to live in the Kuffar’s lands?
But what if a Muslim country starts an attack while you’re among the Kuffar, therefore, you’re subjected to that attack?
In what status will you die then?
What will be your status with Allah Subhanahu Wa Ta’ala according to the Hadith quoted above?

So, my brother, can you understand your status now?


Think of this, Muslims who were in prostration were killed but Rasulullah Sallillahu Alaihi Wa Sallam didn’t rebuke the Mujahideen for killing the Muslims, nor did He criticize them saying, “It is haram in Islam to kill innocent people” though it is true that it is Haram in Islam to kill innocent people (Quran 5:32).

He neither punished them nor make a Takfir on them saying “Killing a Muslim is Kufr” though it is true that it is Kufr to kill a Muslim (except in certain events). (Quran 4:93) (Saheeh Bukhari 6785, 6865)

And then, read this Ayah now.
This Ayah was revealed about those Muslims who didn’t make Hijrah to Madinah and then, they were killed in Badr.

“Verily, as for those whom the angels take (in death) while they are wronging themselves (as they stayed among the disbelievers even though emigration was obligatory for them), they (angels) say (to them):

“In what (condition) were you?”
They reply: “We were weak and oppressed on the earth.”
They (angels) say: “Was not the earth of Allah spacious enough for you to emigrate therein?”
Such men will find their abode in Hell — what an evil destination!”
[al-Nisa’ 4:97]

May Allah save us from being killed while living in the Kuffar’s land.
May Allah save us from dying in the Kuffar’s lands.
May Allah make our Hijrah easy!

بَابُ النَّهْيِ عَنْ قَتْلِ مَنِ اعْتَصَمَ بِالسُّجُودِ حَدَّثَنَا هَنَّادُ بْنُ السَّرِيِّ، حَدَّثَنَا أَبُو مُعَاوِيَةَ، عَنْ إِسْمَاعِيلَ، عَنْ قَيْسٍ، عَنْ جَرِيرِ بْنِ عَبْدِ اللَّهِ، قَالَ: بَعَثَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ سَرِيَّةً إِلَى خَثْعَمٍ فَاعْتَصَمَ نَاسٌ مِنْهُمْ بِالسُّجُودِ، فَأَسْرَعَ فِيهِمُ الْقَتْلَ قَالَ: فَبَلَغَ ذَلِكَ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَأَمَرَ لَهُمْ بِنِصْفِ الْعَقْلِ وَقَالَ: أَنَا بَرِيءٌ مِنْ كُلِّ مُسْلِمٍ يُقِيمُ بَيْنَ أَظْهُرِ الْمُشْرِكِينَ. قَالُوا: يَا رَسُولَ اللَّهِ لِمَ؟ قَالَ: لَا تَرَاءَى نَارَاهُمَا قَالَ أَبُو دَاوُدَ: رَوَاهُ هُشَيْمٌ، وَمَعْمَرٌ، وَخَالِدٌ الْوَاسِطِيُّ، وَجَمَاعَةٌ لَمْ يَذْكُرُوا جَرِيرًا صحيح دون جملة العقل

Why Hijrah! WARNING: The FATWA – Shirk and Kufr in the Citizenship of the Kuffar’s lands

AsSalamu Alaikum Wa Rahmatullahi Wa Barakatuhu.

Now, before you have to think or plan about Hijrah or for you to take this opportunity of MASS Hijrah, you have to know why you MUST do Hijrah!

We are going to place the PRELUDE of this project in the next few parts of this booklet, ‘Why Hijrah!’


The Fatwa:
By the Hāfidh, Shaykh al-‘Allāmah Sulaymān Ibn Nāsir al-‘Alwān (فك الله أسره).

|| What’s the ruling on travelling to dār al-Kufr and attaining their citizenships? ||


Sheikh replied:
The brother asks about residing in the lands of the kuffar to attain their citizenship.

Firstly, acquiring the citizenship of the kuffar is prohibited by default in all cases. Because what it means to acquire a citizenship is to comply with their systems, making tahakum to them, and submitting to their laws, and that you become an individual from amongst them.

It is not possible that a Muslim can become an individual from amongst the men of the kuffar, nor a soldier from amongst the soldiers of the kuffar. Because the condition that is to be known by ‘urf (traditions), is on the same level of a pronounced condition (for e.g. If you buy a car, by the ‘urf, it should have a steering wheel, even though you don’t have that condition in the contract).

It’s not a (pronounced) condition that the kafir stipulates you becoming a soldier from among their soldiers, but this is something well-known; the condition that is to be known by ‘urf (traditions) according to the fuqaha (scholars of fiqh) is on the same level of a pronounced condition.

So whenever you acquire their citizenship, then the laws of every land [you go to] would apply upon you, and the laws are mandated in all lands. For that reason, when citizenships initially came out, and some Muslims acquired citizenships due to being subjected to severe harm, and [due to] the pressure from their rulers or the torture they would face. This issue was brought up around about 60 years ago, and no one at the time differed concerning its prohibition which is astonishing [compared to our times]. Rather, they differed upon whether he becomes a kafir or not, and they had two opinions regarding that:


1 – There are those who said he becomes an apostate; by merely acquiring the citizenship, he would become an apostate.

2 – And others said he does not become an apostate, because he is Mukrah (under compulsion, fleeing torture, etc.), however, he is sinful by that (as he shouldn’t have acquired it, but rather remained in their land temporarily, Wallahu A’lam).

The dispute was concerning his kufr, and it was not surrounding the prohibition of attaining it. However, the dispute now has become surrounding whether it is prohibited, is it halal or haram? And in reality, looking at it from the perspective that he is Mudtar (in serious need), the Mudtar is not required to take citizenship.
Although, yes, if he was Mudtar to take citizenship in the sense that if he does not take it, he will be sent back to his and where he will be tortured, then yes in this situation he will be Mukrah. However, it is compulsory upon him to solidify in his heart not to make Tahakum to them, to make takfir of them, and to proclaim bara’ah from them.


As for the issue of travelling to the lands of the kuffar:
The default basic principle concerning that is prohibition according to the scholars.


So this is proof that whoever remains in the lands of the kuffar, and does not make hijrah while he is able to migrate, then he has fallen into one of the major sins.


However, Imam al-Bukhari, Abu Hatim, Abu Zur’ah, at-Tirmidhi

Tirmidhi and ad-Daraqutni, declared that this report is Mursal, and what is correct is that it is from the narration of:
Isma’il ibn Abi Khalid > from Qays ibn Hazim > from the Prophet (صلى الله عليه وسلم).

And Qays ibn Hazim is Mukhadram (someone who lived in the time of jahiliyyah and era of the Rasul but did not meet him to become a sahabi, but still accepted Islam). And his Mursal narrations are from the strongest of Marasil (Mursal narrations), therefore this is included with the other proofs to prove the prohibition of travelling to the lands of the kuffar.

But if an individual had a need to travel to the land of the kuffar, such as for trade or treatment and so forth, he must take into account several matters:

  • To display his deenn, by making Bara’ah from them.
  • 2 – That he is able to protect himself from fitnah. Therefore whoever is not able to protect himself from fitnah, then he is prohibited from travelling to their lands.
  • 3 – That this is for a need.
  • 4 – That his journey expires when his need is fulfilled.


As for those who travel to lands which might be called ‘Islamic states’:
Most people today cannot differentiate between an Islamic state and a kafir state. So they call a land which does not rule by what Allah has revealed as an Islamic state, that even the Rafidi state, the state of Iran is called an ‘Islamic Republic’, because they do not differentiate between Islam, shirk, and kufr. They simply go by labels, and what the newspapers portray to them, that is what they go towards and mimic.

Thus if an individual travelled to some of these statements, and he went for an enjoyable time, he will find prohibitions and corrupt deeds, people going out dressed immodestly, and public adornments. He will see what gets exposed [from evil] and crimes, while he is unable to change anything, then it Is not permissible to travel in all cases in such a situation.

Consequently, the scholars have unanimously agreed that whoever sits in a place that has haram, it is compulsory upon him to condemn it with his hand or tongue. And if he is unable to do so, it is not sufficient that you rebuke it in your heart, you must leave the gathering if you have the ability to do so. And they have unanimously agreed that it is not permissible for you to travel to a place that has haram, while you know that you will not be able to change it.

This person goes to a place and knows he will see Haram while being unable to change it, and knows with certainty that he will see haram, not just a high assumption, rather, he has Yaqin that he will see haram, while he is unable to change it.

So why would you go there?

You have no need or benefit, nor da’wah or ordaining good and forbidding Munkar, nor did you go there to teach, nor did you go for helping anyone, rather you went there for an enjoyable time. He takes his family and children and makes them subjected to temptations and danger. The likes of these people are to be scolded and deterred from doing this and ordered to preserve their din and ‘Aqidah.

And if Imam Malik (رحمه الله) would say, that if a person resides in an Islamic land, an Islamic state, an Islamic Khilafah, however in this particular land, many corruptions are found and he is unable to change it, and he is able to travel to another (Islamic) and which condemns corruption, then this is obligatory upon him!

Malik views that if someone is under a ruling of an Islamic Khilafah, and there are two (Islamic) lands, one of them is filled with corruption while you are unable to change that, and another land you go to wherein you are able to rebuke the corruption you see, Malik says it is an obligation upon to make hijrah.

So imagine if Malik heard about the issues of our times, a land of kufr, a land of prostitution, a land of despicable evil, a land of Zandaqah, a land which promotes corruption and Munkarat. They give Fatawa allowing travel there. These people are Juhhal. He does not have firmly grounded knowledge, nor does he have din. In fact, he cannot even differentiate between Islam and Kufr.

He would sit with the kuffar and does not see anything wrong with that, and at times, they would give precedence to the kuffar over the Muslims. These people are to be scolded severely, and not to be allowed to speak in such enormous matters.

A little light over the Fatwa:

What Sheikh mentioned as ‘urf’, is tradition, which means the law of the land that you can be subjected to tradition without even mentioning them in the contract. such as, he mentioned, to be a soldier.

But these things are clearly mentioned as the duties and responsibilities of a citizen for one has to comply to be a citizen.  Specifically three duties mentioned that one has to consent in order to become a citizen are:

  1. You have to do a ‘Jury Duty’ in a court when you are called. (Meaning you have to participate in the Kuffar’s law)
  2. You have to vote in the democratic elections (Meaning, you have to participate in the system of Kufr)
  3. You have to join the army if called in an emergency. (Meaning, you have to fight for your Kuffar’s nation even if it is against Muslims, which is Kufr)

So, clearly, we became citizens by giving our consent to comply with those clear Kufr acts, unknowingly.

Inna Lillahi Wa Inna Ilaihi Rajiun!

May Allah protect us from these Kufr acts. And May Allah save us from this.

So, my brother, go back and read the Fatwa again and you will have no doubt understanding that obtaining citizenship of a country governed by the Kuffar’s law and consenting to those Kufr act is Kufr.

Therefore, Muslims must know that the matter is serious, no doubt about that. We need to stand before our RABB with LA ILAHA ILLA ALLAH both by the intention and by the action.
